Aggiornamento sul DM 186/2017 / Update on Decree 186/2017

  • trasparenza e consultazione: permette alla Commissione e agli altri Stati membri di esaminare le nuove leggi nazionali;
  • prevenzione delle barriere commerciali: evita che le normative di un singolo paese creino ostacoli ingiustificati alla libera circolazione di beni e servizi nell’UE;

On June 24th, the “Draft regulation updating the Decree of the Italian Ministry of the Environment n. 186 of November 7, 2017” was uploaded to the European Commission’s TRIS portal for assessment (https://technical-regulation-information-system.ec.europa.eu/it/notification/28062).

The purpose of notification within the European Commission’s TRIS (Technical Regulation Information System) is to prevent the emergence of barriers within the European Single Market. It allows Member States to communicate draft technical regulations before they are adopted. The procedure’s main objectives are:

•     transparency and consultation: it enables the Commission and other Member States to examine new national laws;

•     prevention of trade barriers: it prevents a single country’s regulations from creating unjustified obstacles to the free movement of goods and services within the EU;

•     standstill period: it mandates a freeze on the national legislative process for at least three months (extendable), during which the Commission assesses the regulation’s compatibility with European law.

The standstill period is set to end on September 25, 2026. Only after this date – provided there are no adverse opinions from the Commission or other Member States – the update to Ministerial Decree No. 186 will be enforced.
